Terms of Service

These Terms of Service ("Terms") govern access to and use of InstaSurv, the InstaFlow™ client workflow tools, and related services (together, the "Service") provided by Oncommerce Limited ("we", "us", "our").

By creating an account, starting a trial, or using the Service, you agree to these Terms on behalf of yourself and, where applicable, the surveying practice or organisation you represent.

InstaSurv is a cloud platform for survey practices including CRM, reporting, client portals, quoting, invoicing, and related workflow tools. Features may vary by subscription plan and may change over time as we improve the product.

We provide the Service on a subscription basis. New practices may receive a limited number of free report PDFs to evaluate the platform. Continued report generation and full commercial use require a paid subscription per active staff user unless otherwise agreed in writing.

You are responsible for keeping login credentials secure and for activity under your account. You must provide accurate practice and billing information and notify us promptly of unauthorised access.

You must not misuse the Service, attempt to access other tenants' data, interfere with platform security, upload unlawful content, or use the Service in a way that breaches applicable law or professional obligations.

You retain ownership of data, reports, images, and other content you upload or create in the Service ("Customer Data"). You grant us a limited licence to host, process, back up, and display Customer Data solely to provide and support the Service.

You are responsible for obtaining any consents required from your clients and for the accuracy and professional content of reports and communications issued through the Service.

Subscription fees are quoted per user and are exclusive of VAT unless stated otherwise. VAT will be added at the applicable UK rate at checkout or on invoice.

Fees are billed in accordance with your chosen plan (monthly or yearly). Failure to pay may result in suspension or termination of access after reasonable notice.

We aim to keep the Service available but do not guarantee uninterrupted access. Planned maintenance and occasional outages may occur. Support is provided by our UK-based team during UK business hours on a reasonable-efforts basis.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss of business opportunity. Our total aggregate liability arising from the Service in any twelve-month period is limited to the fees paid by you for the Service in that period.

The Service is a tool to assist your practice. You remain responsible for professional survey work, reports, and advice issued to your clients.

You may cancel your subscription in accordance with your billing settings. We may suspend or terminate access if you materially breach these Terms or fail to pay fees.

On termination, you may export your data within a reasonable period where the Service provides export functionality. We may retain backups for a limited period as required for legal or operational purposes.

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
